1) General information
The products on the e-commerce site www.mikejokers.com are offered by Mike Jokers, a company registered in the Florence Company Register with tax code 04253320487 and VAT number 04253320487 - Share capital Euro 50,000. The headquarters are in Scandicci (FI) Via E. Codignola 14/16, Italy (“The Bridge”).
The email address is customercare@thebridge.it; the telephone number is +39 0534 409022. Purchases made online on the e-commerce site are governed by Italian law and by these contractual conditions indicated on the site at the time the order is placed (the "General Conditions"). Any dispute that may arise regarding the conclusion, interpretation, and execution of a sale concluded through The Bridge e-commerce site will be submitted to the exclusive jurisdiction of the Italian judicial authorities.
2) Users and Orders
The Bridge e-commerce site may only be used by end consumers, i.e., adult individuals acting for purposes unrelated to any commercial, entrepreneurial, artisanal, and/or professional activity they may engage in, and who fall within the definition of "consumers" contained in Legislative Decree 206/2005 and subsequent amendments (the "Consumer Code"). The Bridge will consider valid and effective and will only process purchase orders that meet the following criteria:
- orders may only come from the following countries - each of which will have its own price list -: Italy, France, Spain, Germany, Great Britain, Austria, Belgium, Denmark, Sweden, Netherlands, Russian Federation, Finland, Luxembourg, United States of America, Switzerland, Poland, Romania, Portugal, Ireland, Bulgaria, Croatia, Sweden;
- orders can only be processed if they concern a maximum of 10 items, and, in any case, for a maximum total value of €10,500.00;
- Orders will be processed by The Bridge only if shipping is requested within the territory indicated on the price list from which the order was placed.
Any orders that do not meet the above requirements will not be accepted, and if accepted, may be deemed invalid and ineffective by The Bridge. The Bridge reserves the right not to process orders that do not meet the above requirements.
It is also understood that The Bridge may not process the order and/or deem it invalid if it is not possible to verify the accuracy of the shipping address and billing information, or if the order was placed for resale purposes. In such cases, The Bridge reserves the right to terminate the contract with immediate effect by simple written communication via email.
3) Prices
The Bridge product prices will be specific to each country from which the order originates and will include (before) any applicable taxes. The Bridge may apply special promotions to one or more products on the site that will affect their prices. The essential product features and prices are indicated in the product information sheet on the site, which the user must access before placing an order. Product images may not fully reflect the actual product.
4) Shipping
The e-commerce user will be responsible for shipping costs, which will be explicitly indicated during the purchase process. The Bridge, acting on behalf of the user, undertakes to stipulate a shipping contract with a leading company, taking into account the carrier's terms and conditions.
The user:
- you may specify that the purchase be shipped to an address other than that of the order holder and/or billing address (but always within the same country);
- You must provide a shipping address where someone will always be available to collect the package. If there is no one available to collect the package at the address provided, you must provide a different address than your residence, provided the required condition is met.
The Bridge will generally process your order within 48 hours of receiving payment confirmation. Estimated delivery times depend on the carrier selected. Furthermore, once your order has been shipped, The Bridge will automatically send you an email containing all the information you need to track your order, including a direct link to the DHL or other carrier's portal for immediate delivery status. The Bridge is not responsible for any failed or delayed delivery of your package if the collection procedures described above are not followed or if the customer provides incorrect information.
If the ordered items are not delivered within 10 business days of order confirmation, the user may contact The Bridge customer service directly. The order status and/or shipping status will be checked by the shipping company. The products will, however, be delivered as quickly as possible and in any case within the legal deadlines (i.e., pursuant to Article 61 of the Consumer Code, 30 days from the Delivery Date). In certain circumstances, such as, but not limited to, sales periods or factory closures, delivery times may vary. The Bridge cannot be held liable for delivery delays not attributable to its fault or negligence. Therefore, The Bridge will not be liable for delays due to force majeure, strikes, natural disasters, pandemics, customs clearance procedures, and any other circumstances related to the provision of courier services, or any other circumstances beyond its control and/or unforeseeable. Without prejudice to the foregoing, the user is requested to do everything possible to facilitate the delivery of the order, either by making themselves available to receive it or by delegating this task to a third party. Upon delivery, the user must verify the accuracy of the number of packages and the integrity of the external packaging. If the user finds any anomalies in the delivery, for example regarding the number of packages or damage to the external packaging, they must sign the delivery document with reservations and contact The Bridge customer service. Failure to do so will result in the user being unable to subsequently raise any dispute regarding the delivery, except as provided in Article 13 below regarding hidden defects and in compliance with mandatory consumer protection laws.
5) Order Compilation
To complete the purchase agreement, the user must complete the order process on the website in its entirety and confirm payment for the order on the website of the selected payment provider. It is understood that orders from countries other than those indicated and with characteristics different from those specified above (in terms of quantity and shipping location) will not be accepted under any circumstances.
6) Procedures for filling in and information
Before completing the order, the user must access the FAQ section, which contains the identity and address, including email address, of The Bridge, shipping costs, any other information relating to the execution of the contract, the existence of the right of withdrawal, and the methods and times for returning the product if exercised, as well as all other information relating to the General Terms and Conditions. The General Terms and Conditions may be saved and/or printed by the user.
7) Procedure for filling in and technical information
The user can also access the FAQ section, which contains further information on the operating procedures to be followed to conclude the contract and the technical means to be used to correct any errors before submitting the order.
8) Order and Information
During the order process, you will be provided with a series of summary information on the product's features, price, shipping costs, delivery methods, and payment options.
9) Order filling and responsibilities
To complete the purchase contract, the order and payment process must be completed on the selected entity's website. Both steps must be performed following the instructions on the website. If, due to a typing error or other errors, orders are placed that the user does not wish to place due to characteristics, quantities, and/or prices, the user must not complete the order process. The user is responsible for the accuracy of the information provided during the order and payment process, and The Bridge assumes no responsibility for unwanted orders, orders placed by mistake, and/or orders placed by minors. The Bridge will process such orders in accordance with the information provided by the user and may demand payment of the agreed-upon price.
If, during the order process and contract conclusion, you notice that the price of one or more of the products you intend to select for subsequent purchase is clearly lower than the standard price, net of any discounts and/or promotions in effect at that time, due to an obvious technical problem on the site, you are requested not to complete your purchase order and to report the aforementioned technical error to The Bridge by sending an email to customercare@thebridge.it.
In cases where the user has completed their purchase order and the latter includes a product whose price is clearly lower than the standard price, net of any discounts and/or promotions in effect at the time, due to an evident technical problem that has occurred on the site:
(a) if the user has not yet received the product, The Bridge will (i) cancel the order, the delivery of which will therefore not be carried out, simultaneously sending a communication to this effect via email to the email address indicated by the user when completing and transmitting the order and (ii) refund the user for the payments made by the same in relation to the cancelled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same payment method used by the user for the initial transaction;
(b) if the user has received the product, The Bridge will promptly inform the user via email of the error that occurred in the process of completing their order, offering the user, alternatively, to (i) pay The Bridge, within and no later than the following 5 (five) days, using one of the available payment methods, the amount corresponding to the difference between the correct price of the product and the incorrect price resulting from the purchase order, or (ii) cancel their order, following the instructions contained in the same communication and returning the product to The Bridge, at the latter's expense, within and no later than the following 14 (fourteen) days, sending it to The Bridge, undamaged, complete with all its elements and accessories (including labels and tags unaltered and attached to the product), accompanied by the attached instructions/notes/manuals, the original packaging and wrapping and the warranty certificate and accompanied by the duly completed return form, which will be found attached to the email sent by The Bridge.
If the user has chosen the option referred to in the previous point (b) (ii), The Bridge will refund the user for the payments made by the same in relation to the cancelled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same payment method used by the user for the initial transaction.
10) Order archiving
The order confirmation and related data will be stored in The Bridge's electronic database for the period necessary to process the order, and in any case for the period required by law.
An order confirmation will be sent to the user via email with all the order details. This information will also be visible to registered users in the My The Bridge section.
11) Conclusion of contract
The contract is concluded between the time The Bridge receives the electronic order confirmation and the time The Bridge receives the payment confirmation from the selected entity, after verifying the accuracy of the data entered. The Bridge reserves the right to refuse the order by notifying the customer via email within 2 days of receiving it, in the event of incorrect data or an invalid and/or incorrect credit card number being forwarded to the selected entity.
12) Product unavailability
If the products listed on The Bridge's e-commerce site are no longer available, The Bridge will notify you within 30 days of receiving your order. If you have already paid for the product, The Bridge will refund the amount paid. In this case, The Bridge will not be liable for any damages or other compensation.
13) Legal guarantee
Without prejudice to the provisions of the previous article 4, The Bridge assumes responsibility for any lack of conformity of the products existing at the time of delivery of the products themselves and which becomes apparent within two years of delivery.
The Bridge guarantees the user that the products sold are not defective and that they comply with the provisions of the order and, therefore, in particular, that the products:
- comply with the description provided on the site and possess the qualities of the products that The Bridge has presented;
- are appropriate for the purpose for which goods of the same type are normally used;
- have the quality and performance which are normal in goods of the same type and which the user can reasonably expect, taking into account the nature of the goods.
For technological reasons, The Bridge cannot guarantee that the color display on the screen of the devices used to access its website will always be accurate, complete, and up-to-date. Minor differences between the product description on the website and the actual product characteristics will not be considered a cause of non-compliance for the purposes of the order. The guarantee of conformity for products sold on the website lasts for a period of 2 (two) years from the date of receipt of the products by the user. The sale of The Bridge products is subject to the provisions of Articles 129, 130, and 132 of the Consumer Code. In the event that a non-compliant Product is delivered, the user may request that the products be restored to conformity, free of charge, through repair or replacement. Where this is not possible under applicable law, the user will be entitled to a corresponding reduction in the purchase price or a refund of the purchase price and (if applicable) shipping costs.
The user will notify The Bridge of any product non-conformity within two years of delivery through customer service. After receiving this notification from the user, The Bridge will contact the user to arrange product collection directly. The Bridge's mere receipt of the products after initiating the aforementioned procedure does not in any way imply recognition by The Bridge of a lack of conformity, as a thorough inspection by The Bridge is required. Claims for hidden defects expire, in any case, twenty-six months after delivery of the product. Without prejudice to the foregoing, the warranty does not cover damage caused by mishandling of the products, misuse, accidents, water, solvents, wear and tear, damage caused by carriers, or, in any case, damage resulting from third-party factors and not attributable to product non-conformity.
14) Additional guarantee
In the event of a lack of conformity, provided that such defect is not due to the same causes that exclude the legal guarantee pursuant to Article 13 above, the user/purchaser may, as an alternative to the legal guarantee, exercise the additional warranty provided by The Bridge on The Bridge products by contacting The Bridge's customer service department, to whom the complained defect must be reported by fax or email. This warranty, which lasts two years from the date of purchase, means, if granted, that the user's complaint is exempt from the limitation periods set forth in Article 132 of the Consumer Code. The user will be entitled to repair and/or replacement of the product, and the related costs, including shipping, will be borne by The Bridge.
15) How to activate the additional guarantee
The extended warranty is provided only after reporting the defect and upon presentation to The Bridge of one of the following documents, which are essential conditions for accessing the service: the warranty coupon included in the packaging with the purchase date confirmed by the retailer's stamp, purchase receipt, invoice, or e-commerce order code. Before sending the product to The Bridge, you must complete the return request form in its entirety and fax or email it to The Bridge customer service. The form must be accompanied by one of the documents listed above. Only after accurate and complete receipt of the required documents will The Bridge issue a return authorization number, which the user must include on the package in which the product is returned. In this case, shipping costs will be paid by The Bridge. Warranty requests made in any other manner will not be accepted. If the user is incorrectly approved for the service, The Bridge may charge the shipping costs incurred. If the product received by The Bridge is not covered by the warranty because there are no defects attributable to The Bridge itself, as indicated in the previous section 13, the repair and/or replacement may still be carried out at the user's expense, provided that the product is repairable and/or replacement is possible. In this case, The Bridge will send the user a repair and/or replacement cost estimate, which must be returned to The Bridge by the person requesting the service for acceptance. No non-warranty repairs and/or replacements will be carried out without the prior consent of the person requesting them. Repair and/or replacement times vary depending on the type of repair and product availability. Warranty repairs are generally completed within 3 weeks of receiving the product and/or, in the case of non-warranty repairs, upon receipt of the written approval of the estimate from the user. Non-warranty repairs will only begin once The Bridge receives written approval of the estimate from the user.
16) Payments
Payment for online purchases made on The Bridge website can only be made by Visa, American Express, or Mastercard credit cards via the Setefi system, or via PayPal.
If you purchase with Scalapay, you'll receive your order immediately and pay in three installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related parties, and their assignees, and that you authorize such assignment.
The order amount will be charged to your credit card only upon shipment. Payment for orders is processed externally to The Bridge systems (within the Setefi and PayPal servers), which is therefore in no way the owner or responsible for the processing of your bank details or the credit card information used for payment.
17) Withdrawal
The buyer has the right to withdraw from the contract entered into with The Bridge within 14 business days of delivery of the products without penalty and/or reason. To exercise the right of withdrawal, the buyer must send a registered letter with acknowledgement of receipt within 14 days of receiving the goods, expressly declaring their wish to return the ordered goods. The communication may also be sent by fax and/or email, provided it is confirmed by registered letter with acknowledgement of receipt within the following 48 hours. The right of withdrawal may be exercised if multiple products are purchased, even if only some of them. If the right of withdrawal is exercised, the user must return the purchased goods to The Bridge at their own expense, sending them to The Bridge within 14 days of the date of exercising the right of withdrawal. All goods must be returned to The Bridge's address. To be eligible for a return, the purchased products must arrive at the above address in perfect condition. The product must be returned in its original packaging and with the product tag attached. To return the product, please follow the steps outlined in the return procedure, accessible through the FAQ section. If the return is not exercised as described above, The Bridge will not accept the returned products and will return them to the user/customer without additional shipping costs.
17 bis) Exclusion of the right of withdrawal for customized products
Pursuant to and for the purposes of Article 59 c) of the Consumer Code, the right of withdrawal, cancellation, or return is excluded in the case of orders relating to customized or clearly personalized products based on the choices made by the buyer.
18) Returns
Returned products (which is the buyer's responsibility) must be packaged in the original box to prevent the goods from arriving damaged at their destination. Only if the original packaging is unusable can a box of equivalent size and sturdiness be used. Return shipments made using methods other than those indicated above, which are the only authorized methods, will not be accepted. Returns following a withdrawal cannot be made with costs borne by the recipient. Once the return arrives, The Bridge will verify the legitimacy of the return and, having verified the correctness of the transactions, will send the user a confirmation email. The sums paid will be refunded via the payment method used. Refunds are generally made within 14 days of the later of the date The Bridge receives notification of the withdrawal and the date The Bridge receives the returned product from the buyer.
19) Controversies
Any sales contract concluded between The Bridge and the buyer pursuant to these General Conditions will be governed by and interpreted in accordance with Italian law, and in particular the Consumer Code. In any case, any rights granted to buyers by mandatory provisions of law in force in their country will be unaffected.
The buyer has the right to access the European Online Dispute Resolution platform (the European ODR Platform) to resolve any dispute with The Bridge.
